> SEC. 42.15. PEDDLING, HAWKING AND VENDING IN BEACH

A. No person shall hawk, peddle, vend or sell, or
>
request or solicit donations for, any goods, wares,
>
merchandise, foodstuffs or refreshments upon any
>
public beach lands or beach properties adjoining the
>
waterfront of the Pacific Ocean, or upon any
>
boardwalk, sidewalk or public way immediately
>
adjacent thereto between the southerly boundary of
>
the City of Santa Monica and the northerly boundary
>
of the City of El Segundo and between the
>
northwesterly boundary of the City of Santa Monica
>
and the northwesterly boundary of the City of Los
>
Angeles.
>

B. No person shall use any City-owned or maintained
>
street furniture or structure, including, but not
>
limited to, any bench, planter or trash receptacle,
>
installed on public property for the display of
>
anything whatsoever in connection with the sale, or
>
offer for sale of any goods, wares, merchandise,
>
foodstuffs or refreshments.
>

C. No person shall engage in activities not
>
otherwise prohibited by this section between the
>
hours of 10:30 p.m and 9:00 a.m.

Nothing in this section contained shall be
>
applicable to prohibit the sale or offering for
>
sale, or the possession, control or custody of
>
newspapers, magazines, periodicals, or other printed
>
matter commonly sold or disposed of by news vendors,
>
nor shall the same be applicable to or prohibit
>
persons engaged in the selling or offering for sale
>
or disposing of newspapers, magazines, periodicals,
>
or any other such printed matter from crying,
>
calling attention to, hawking, advertising or
>
proclaiming the same.

>
This section shall not prohibit the sale of
>
merchandise constituting, carrying or making a
>
religious, political, philosophical or ideological
>
message or statement which is inextricably
>
intertwined with the merchandise. Nor shall the
>
provisions of this section prohibiting sales or
>
solicitations of donations apply to any performer or
>
musician engaging in constitutionally protected
>
activities, or to any painter, sculptor or
>
photographer, provided the painter, sculptor or
>
photographer is displaying his or her own original
>
creations and/or limited editions. Each such
>
painting, sculpture, photograph or limited edition
>
thereof shall bear the original signature of the
>
painter, sculptor or photographer and said painter,
>
sculptor or photographer shall be in possession of a
>
valid, signed personal photographic identification
>
card or document at all times while engaging in
>
activities which would otherwise be prohibited by
>
this section.
